What conditions can legally inspected goods meet to apply for exemption from inspection?

The Commodity Inspection Law stipulates that import and export commodities that are included in statutory inspections and import and export commodities that are required by other laws and regulations to be inspected by entry-exit inspection and quarantine institutions may be exempted from inspection upon application by the consignee or shipper and approval by the national entry-exit inspection and quarantine department. All import and export commodities that apply for exemption from inspection must comply with the requirements specified in the "Measures for Exemption from Inspection of Import and Export Commodities" (August 1, 1994). Exemption from inspection is an incentive measure for certain high-quality products. The state authorizes the entry exit inspection and quarantine department to exempt high-quality goods that meet the requirements from inspection after review and approval.

(1) Applicants applying for exemption from inspection shall meet the following conditions:

① Import and export commodity production enterprises that apply for exemption from inspection must establish a sound quality assurance system; The production enterprise of imported goods shall be recognized by the State Administration for Entry Exit Inspection and Quarantine or assessed by relevant institutions with certification agreements, and obtain a quality system review certificate issued by them; The quality system of production enterprises for export goods should be reviewed by a quality system review agency recognized by the China National Import and Export Enterprise Certification Body Accreditation Board (CNAB), and obtain a production enterprise quality system review certificate issued by it.

② The quality of import and export commodities applying for exemption from inspection should be stable for a long time, and the inspection qualification rate of entry-exit inspection and quarantine institutions should reach 100% for three consecutive years.

③ Chinese users of imported goods or foreign users of exported goods have no quality objections to the imported and exported goods that have been exempted from inspection.

(2) Import and export goods that involve safety, hygiene, and the following special requirements cannot be exempted from inspection.

① Grain, oil, food, toys, cosmetics, electrical appliances, etc.

② Goods included in the management of import safety and quality licenses.

③ Goods or bulk goods that are prone to quality changes.

④ The contract requires the pricing and exchange settlement of goods based on the ingredients and contents listed in the product inspection certificate.

⑤ Packaging containers for import and export of dangerous goods.
